Marvel Vs. NCSoft

A few decisions in the legal battle over the characters in NCSoft's City of Heros have been made.

A U.S. district court judge in Los Angeles dismissed several key claims by comic book publisher Marvel Enterprises, Inc in the company's trademark and copyright infringement case against online computer game publisher NCsoft® Corporation and game developer Cryptic StudiosTM.

Marvel Comics brought NCSoft to court over a year ago claiming that the players of NCSoft's game City of Heros could make characters that resembled the characters created by Marvel Comics. The judge in this case has dismissed some of the prime examples of the case because the characters created in City of Heros were created by employees of Marvel Comics.

The judge also threw out Marvel's claims that NCSoft purposely infringed Marvel's registered trademarks and dismissed a claim that NCSoft should be declared as not an Online Service Provider. NCSoft is happy with these dismissals although some claims still stand and NCSoft has until March 21st to refute any of these claims.
